Ten ICE (Immigration and Customs Enforcement) agents filed a lawsuit against Department of Homeland Security Secretary Janet Napolitano last week challenging the new Deferred Action/Dream Act policy. They claim that this new directive forces ICE officials to break the law and ignore their duties of deporting individuals who lack legal immigration status.

 The lawsuit was filed in Texas federal court. The ICE agents argue that the Deferred Action/Dream Act policy violates the separation between the legislative and executive branches of  government.

 So far, the Supreme Court has ruled that the government has the  power of “Prosecutorial Discretion,” which is what defenders of the Deferred Action/Dream Act  argue.

Some people have been asking whether a person can obtain a driver’s license after approval of Deferred Action/Dream Act.


Well, in Texas, the answer is YES! According to the new Texas department rules, a person granted Deferred Action can get a limited term  driver’s license for one year or less. Someone granted Deferred Action would need to show the Texas Department of Public Safety, their employment authorization document in order to get the driver’s license. 
 
Although, ideally, it would be better to get a longer lasting license, at least this is a start.

U.S. immigration started to accept Deferred Action/DREAM Act  applications this week on Wednesday, August 15. Some foresee that this
immigration policy may benefit over one million young people.

Although the actual application forms have not been posted by immigration regarding the new Obama immigration policy known as "Deferred Action," there is news of how much this process will cost.

The filing fee will be $465.

The Deferred Action program, which some refer to as the Dream Act (although it is not), will be implemented on August 15, 2012.

The requirements for Deferred Action have been modified. Please note the updated rules for a person to qualify: 

1. Was under  the age of 31 as of June 15, 2012; 

2. Came to  the U.S. before reaching his/her 16th birthday; 
 
3. Has continuously resided in the U.S. since June 15, 2007, up to the present time; 
 
4. Was  physically present in the U.S. on June 15, 2012, and at the time of application to USCIS; 

5. Entered  without inspection before June 15, 2012, or lawful immigration status expired as of June 15, 2012; 

6. Is  currently in school, has graduated or obtained a certificate of completion from
high school, has obtained a GED, or is an honorably discharged veteran of the
U.S. Coast Guard or the U.S. Armed Forces; and 
 
7. Has not  been convicted of a felony, a "significant misdemeanor," three or more other misdemeanors, or does not otherwise pose a threat to national security or  public safety.
